1. General provisions.
1.1 These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the \"Terms and Conditions\") are a legal document binding on the parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of goods and payment for them, the procedure for delivery and return of goods, the liability of the parties and other provisions related to the purchase and sale of goods in the online store Kruta.
1.2 By placing an order, the Buyer confirms that he\/she accepts these Terms and Conditions.
1.3 The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment when the Buyer has created a shopping cart in the online store, indicated the delivery address, selected the payment method and read the Terms and Conditions, and clicked on the \"Buy\" button.
2. Personal data protection.
2.1 When ordering goods in the Kruta online shop, the buyer must provide the data requested at the time of purchase: name, surname, address and e-mail address.
2.2 The Buyer is responsible for providing correct information at the time of purchase.
2.3 By placing an order, the Buyer agrees to the processing of the personal data provided by him\/her for the purpose of the order. The Buyer also consents to the sending of information messages to the e-mail address provided by the Buyer, which are necessary for the execution of the order.
2.4 The personal data of the Customer may be processed for marketing purposes only if the Customer himself\/herself has given his\/her consent.
2.5 The Seller undertakes not to disclose the Buyer's personal data to third parties, except when required by a competent State authority in cases provided for by the laws of the Republic of Lithuania or by the Buyer's separate written consent.
3. Buyer's rights and obligations.
3.1 The Buyer undertakes to pay to the Seller the agreed amount for the goods ordered and to accept them.
3.2 Provide full, complete and correct information on the billing form. If the Buyer provides inaccurate, false or misleading information on the Billing Form, Kruta shall have the right to cancel the Buyer's registration and delete the data.
3.2 In the event of a change in the Buyer's details provided on the Purchase Form, the Buyer must inform the Seller immediately.
3.3 The Buyer shall have the right to withdraw from the contract of sale of the Goods in accordance with the provisions set out in the Return Policy.
3.4 By placing an order in the Kruta online shop, the Customer agrees to these Terms and Conditions of Sale and Purchase and undertakes to comply with them and the provisions of the legislation of the Republic of Lithuania.
4. Seller's rights and obligations.
4.1 The Seller undertakes to provide all the conditions for the Buyer to properly use the services provided by the Kruta online shop.
4.2 If the Buyer attempts to undermine the stability and security of the Online Shop or breaches its obligations, the Seller shall have the right to restrict, suspend or terminate the Buyer's access to the Online Shop immediately and without notice.
4.3 The Seller undertakes to respect the Buyer's right to privacy with respect to the Buyer's personal information contained in the Purchase Form and not to disclose it to any third party.
4.4 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
4.5 The Seller may, in important circumstances, temporarily or permanently discontinue the operation of the Online Shop without prior notice to the Buyer.
4.6 The Seller may unilaterally change the terms of these Terms and Conditions.
4.7 If the Customer uses the services provided by Kruta after the changes to these Terms and Conditions, the Customer shall be deemed to have accepted the change to the Terms and Conditions.
5. Ordering, prices, payment procedures, terms.
5.1 The Online Shop is open for online purchases 7 days a week, 24 hours a day.
5.2 Orders are accepted only through the Kruta Online Shop.
5.4 All prices of goods in the online shop are quoted in euros including VAT and in other currencies including VAT.
5.5 The Buyer undertakes to pay for the order within 24 hours from the date of order confirmation. The preparation of the parcel shall commence only upon receipt of payment for the goods.
5.6 If the Buyer fails to make payment within 24 hours, the order shall be cancelled.
6. Delivery of goods.
6.1 The Buyer undertakes to specify the exact place of delivery.
6.2 The Buyer undertakes to accept the Goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods have been delivered to the address indicated, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong entity.
6.3 The Goods shall be dispatched to the Buyer within 1-3 working days after confirmation of payment.
6.4 In all cases, the Seller shall be exempt from liability for failure to meet delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Seller's control.
6.5 The Buyer must immediately inform the Seller if the consignment is received in damaged packaging, if the consignment contains unordered goods or the wrong quantity of goods, or if the consignment is not complete.
6.6 The Buyer must provide the Seller with photographs of the damaged parcel and\/or item(s) by email.
6.7 When sending goods abroad, delivery charges may vary. The Buyer shall be informed immediately.\u00a0
7. Product quality, guarantees.
7.1 All details of the goods sold in the Kruta online shop shall be indicated in the description of each product.
7.2 The units of measurement are specified in the product description. The colour of the goods may vary slightly depending on the monitor used by the Buyer.
7.3 The Seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are specified in the description of the goods.
8. Marketing and information.
8.1 The Seller may organise various promotions and offers in the Kruta online shop.
8.2 The Seller has the right to unilaterally, without prior notice, modify the terms and conditions of the Promotion, including cancellation. Any modification or cancellation of the terms and conditions of the Shares shall be effective from the time of the modification or cancellation.
8.3 The Seller shall send notices to the Buyer to the email address specified in the Buyer's purchase form.
8.4 The Buyer shall send all notifications and questions to the Seller's contacts specified in the \"Contacts\" section of the e-shop.
8.5 The Seller shall not be liable if the Buyer does not receive the information or confirmation messages sent due to disruptions in the internet connection, the networks of the email service providers, messages entering the SPAM directory or incorrect data provided by the Buyer.
8.6 The Buyer's personal data may be processed for marketing purposes under the conditions set out in Clause 2.4 of these Terms and Conditions.
9. Final provisions.
9.1 These Terms and Conditions of Sale and Purchase of Goods are made in accordance with the laws and regulations of the Republic of Lithuania.
9.2 These Rules shall be governed by the laws of the Republic of Lithuania. Any disagreements arising out of the implementation of these Rules shall be settled by negotiation. Pirk\u0117jas, pateikdamas u\u017esakym\u0105 internetin\u0117je parduotuv\u0117je “Kruta” sutinka su \u0161iomis pirkimo – pardavimo Taisykl\u0117mis ir \u012fsipareigoja j\u0173 ir nustatyt\u0173 LR teis\u0117s akt\u0173.4. Pardav\u0117jo teis\u0117s ir \u012fsipareigojimai.4.1. Pardav\u0117jas \u012fsipareigoja sudaryti visas s\u0105lygas Pirk\u0117jui tinkamai naudotis internetin\u0117s parduotuv\u0117s “Kruta” teikiamomis paslaugomis.4.2. Pardav\u0117jas \u012fsipareigoja pristatyti Pirk\u0117jo u\u017esakytas prekes Pirk\u0117jo nurodytu adresu.4.5. Pardav\u0117jas, susidarius svarbioms aplinkyb\u0117ms, gali laikinai arba i\u0161 viso nutraukti internetin\u0117s parduotuv\u0117s veikl\u0105 apie tai i\u0161 anksto neprane\u0161\u0119s Pirk\u0117jui.4.6. Pardav\u0117jas gali viena\u0161ali\u0161kai pakeisti \u0161i\u0173 Taisykli\u0173 s\u0105lygas.4.7 Jei Pirk\u0117jas po \u0161i\u0173 s\u0105lyg\u0173 pasikeitim\u0173 naudojasi “Kruta” teikiamomis paslaugomis, laikoma, kad Pirk\u0117jas sutiko su Taisykli\u0173 pakeitimu.5. Preki\u0173 u\u017esakymas, kainos, atsiskaitymo tvarka, terminai.5.1. Internetin\u0117je parduotuv\u0117je Pirk\u0117jas internetu gali pirkti 7 dienas per savait\u0119, 24 val. per par\u0105.5.2. U\u017esakymai priimami tik naudojantis Internetine parduotuv\u0117je “Kruta”.5.4.
